Description

The next step in applying for your subclass 482 Temporary Skill Shortage (TSS) visa is fulfilling all of the eligibility requirements. There are quite a few and you are going to have to be diligent and organised when going through the application process. The entry requirements for the subclass 482 Temporary Skill Shortage (TSS) visa are:

Streams

The Subclass 482 Visa has three main streams:

  • For occupations listed on the Short-Term Skilled Occupation List (STSOL).
  • Visa validity: up to 2 years or up to 4 years if an International Trade Obligation (ITO) applies. Hong Kong passport holders may stay up to 5 years.
  • For occupations listed on the Medium and Long-Term Strategic Skills List (MLTSSL).
  • Visa validity: up to 4 years. Hong Kong passport holders may stay up to 5 years.
  • Be nominated to work in a specified occupation under the terms of a Labour Agreement.
  • Unless otherwise specified in the Labour Agreement, have gained at least 12 months relevant full-time work experience, or equivalent, within the last 5 years.
  • Work carried out on a part-time or casual basis must be equivalent to at least 12 months full-time work.
  • Work only for your sponsor.

Process/Steps

  • Having a nominated occupation on the eligible skilled occupation list.
  • Meeting the required level of skills and work experience for that occupation.
  • Holding a valid job offer from an Australian employer who is willing to sponsor you.
  • Meeting the health and character requirements for the visa.
    • Identify whether a skill assessment is mandatory for your occupation

    • Review the relevant skill assessment authority requirements

    • Gather necessary documents, including educational and employment records

    • Submit your skill assessment application and await the outcome

  • Identify the designated authority responsible for assessing your occupation

  • Follow the application process outlined by the respective authority

  • Pay the required assessment fee and submit all supporting documents

  • Determine the required English proficiency level based on your occupation

  • Choose an approved English language test (IELTS, PTE, TOEFL, etc.)

  • Schedule and take the test, ensuring you meet the minimum score required

Your Australian employer must nominate you for the Subclass 482 visa. This step is necessary to demonstrate that the position is genuine and aligns with your skills.

  • The employer will need to show they meet specific obligations, such as offering you a position that pays at least the market salary rate.
  • The employer must also demonstrate that they are compliant with Australian workplace laws and labor market testing (in some cases).

Once your employer’s nomination is approved, you must submit an Expression of Interest (EOI) via SkillSelect. This is an online process where you provide detailed information about your qualifications, work experience, and English proficiency.

  • Your EOI will be ranked based on points (such as age, education, work experience, English ability, etc.), and if you meet the criteria, you will receive an invitation to apply for the visa.

If your EOI is successful, you will receive an invitation to apply for the Subclass 482 visa.

  • The invitation is based on your EOI ranking and available positions. This is not guaranteed, as not everyone who submits an EOI will receive an invitation.

Collect all necessary documentation for your visa application, including:

  • Personal identification (passport, birth certificate).
  • Educational qualifications and transcripts.
  • Work experience and reference letters from previous employers.
  • Skills assessment results (if applicable).
  • English language test results (if applicable).
  • Health and character documents (medical exams, police certificates).

All applicants must meet the health and character requirements.

  • You will need to undergo a medical examination by an approved panel doctor to ensure you meet the health requirements.
  • You must also provide police clearance certificates from any countries you’ve lived in for more than 12 months in the past 10 years to meet the character requirements.

After submitting your application, the Department of Home Affairs will process your Subclass 482 visa application. Processing times may vary depending on the complexity of your case, the accuracy of your documents, and the overall demand for visas.

  • You can track the progress of your application through your ImmiAccount.

If your application is successful, you will receive your Subclass 482 visa, allowing you to work in Australia for your nominated employer.

  • Your visa grant will specify the conditions, including the length of your stay (up to four years), and your employer’s details.
  • Once granted, ensure you comply with visa conditions, such as maintaining your employment with the nominated employer and notifying the Department of any changes to your employment status.
